Pennsylvania's Comparative Negligence Act (42 Pa.C.S. § 7102) allows an injured person to recover as long as their negligence is not greater than the combined negligence of the defendants.
Example
If a jury finds damages of $100,000 and assigns you 20% fault, the recovery is reduced to $80,000. At 51% or more, recovery is barred. (Illustration only.)
Insurers frequently argue comparative fault to reduce payouts. Evidence gathered early can help respond.
