Pennsylvania drivers elect full tort or limited tort (75 Pa.C.S. § 1705). Limited tort typically costs less but restricts recovery of non-economic damages unless an exception applies.
Exceptions to limited tort
- Serious injury, as defined by statute and case law.
- The at-fault driver was convicted of or accepted ARD for DUI.
- The at-fault vehicle was registered in another state.
- You were a passenger in a commercial vehicle, or not an occupant of a motor vehicle.
